Chief Justice DY Chandrachud stated on Saturday that the “bail is the rule, and jail is the exception” approach, which is losing ground in district courts, has to be thoroughly evaluated.
He stated that it is necessary to investigate why district courts are unwilling to give bail and protect persons’ personal liberty.
Even though bail is meant to be the norm and jail the exception, this notion is not implemented in practice. Courts, particularly trial courts, are sluggish to grant bail, therefore three out of every four convicts are undertrials.
Chief Justice DY Chandrachud stated that the district judiciary must always evolve in order to keep the citizens’ faith.
