Public notice introduced by Controller General of Patents, Designs & Trade Marks dated December 16, 2022  states:-

In India, the requirement to file actual copies of the forms for filing a design application has been removed. As a result, design registration forms and documentation can be uploaded online but must be digitally signed in conformity with the Information Technology Act of 2000. This change intends to simplify the design registration procedure and make it more convenient for applicants.

Additionally, starting November 1, 2022, e-certificates for design registration have been issued by the Design Wing of the Indian Patent Office.

There are few exceptions to this requirement, such as assignments, attested/notarized copies of original powers of attorney, and original affidavits, which must still be provided in original to the Design Office.  And also , those who prefer the offline approach will still be able to file forms and documents for design registration using this manner.

Applicants seeking reciprocity must present WIPO-DAS codes or a certified/verified copy of the priority document in original within three months of filing the design application in India.
